RE: The tariff classification of a ground terminal, plate terminal and choke coil assembly from Germany

Dear Mr. Hardy:

In your letter dated July 27, 2010, you requested a tariff classification ruling.

The first item concerned is referred to as a ground terminal (Part # AF196193-8020). This item is a part of a fuel pump electric motor circuit. This terminal is used to connect the negative plate terminal of the electric motor to the pump housing creating a proper ground. This terminal is made of stainless steel.

The second item concerned is referred to as a plate terminal (Part # AF064292-8050). This item is part of a fuel pump electric motor circuit. Two plate terminals would be used within each fuel pump electric motor. This terminal is used to facilitate the flow of electricity to the electric motor (like the metal prongs at the end of an electric appliance power cord). The plate terminal is made of brass that is plated with tin.

The third item concerned is referred to as a choke coil assembly (Part # AF064273-8020). This item is described as a simplified inductor. It is part of the fuel pump electric motor circuit. The purpose of the choke coil is to dampen or suppress current spike radio frequencies that are emitted by the fuel pump. This results in less interference with neighboring electronic equipment. The core of the choke coil is made of ferrite and a strand of grade 1 annealed copper wire is wound around the core.

You have proposed the classification of the ground terminal (Part # AF196193-8020) under subheading 8536.90.4000. Heading 8536 provides for electrical apparatus. The term apparatus has been defined by the Court of International Trade and its predecessor court as a combination of articles and materials which are intended, adapted and necessary for the accomplishment of some purpose. The ground terminal (Part # AF196193-8020), does not fit this definition, it is not manufactured from a combination of materials or articles; it is made solely of stainless steel. As such, classification in heading 8536 would not be appropriate.

The applicable subheading for the ground terminal (Part # AF196193-8020) will be 8503.00.9520, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts suitable for use solely or principally with the machines of heading 8501 or 8502: Other: Other: Parts of motors.” The rate of duty will be 3%.

The applicable subheading for the plate terminal (Part # AF064292-8050) will be 8536.90.4000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical apparatus for switching or protecting electrical circuits, or for making connections…: Other apparatus: Terminals, electrical splices and electrical couplings; wafer probers.” The rate of duty will be Free.

Regarding the classification of the choke coil assembly (Part # AF064273-8020), it has come to our attention that certain published rulings classifying substantially similar merchandise need to be reconsidered so that we do not have in force rulings that may be inconsistent with our current views. We intend to initiate a notice and comment procedure pursuant to 19 U.S.C. 1625(c) to propose to revoke or modify one or more rulings. In this manner, we believe we can best meet our obligations regarding the sound administration of the HTSUS and other customs and related laws. See 19 C.F.R. 177.7(a). As a result, we cannot address the classification of these articles at this time.

We invite you to comment on the relevant proposed modification or revocation, which we will publish soon in an issue of the Customs Bulletin, available at www.cbp.gov. The notice and comment procedure typically takes 60 days from the date of publication of the proposed change before a final modified or revoked ruling is published and, other than as provided in 19 C.F.R. 177.12(e), 60 additional days before the change becomes effective. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
